The main legal act regulating the area of public procurement in Tajikistan is the Law of 2006 on Public Procurement of Goods, Works and Services. The Law applies to all public procurement carried out on the territory of the Republic of Tajikistan, with the exception of those related to national defense, national security, state secrets, precious metals and precious stones, as well as to the elimination of the consequences of emergencies.

The purpose of this law is:

  • ensuring economy and efficiency of public procurement;
  • development of competition among suppliers (contractors) in the field of public procurement;
  • ensuring transparency and impartiality of public procurement procedures;
  • Improving the activities of executive authorities, state enterprises (institutions) and other organizations in the field of public procurement;
  • development of market relations in the field of public procurement.

The main state body in the area of public procurement is the Procurement Unit. The Unit ensures compliance with procurement procedures established by the law, publishes information in the public procurement bulletin, prepares necessary documentation in cooperation with a relevant state entity, develops procurement plans and reports, etc. The Ministry of Finance oversees the public procurement conducted based on the Law on Public Procurement of Goods, Works and Services. Procurement procedures relating to coal, oil and gas are published and handled by the Ministry of Economy and Ministry of Energy and Water Resources.
